so this is the guy who killed that doctor? unfortunately, his charges don't qualify for the death penalty. this guy most definitely deserves no mercy, no forgiveness, especially after committing the crime AT CHURCH! :no:

what DOES constitute the death penalty. I have always wondered this. Its not simply murder as some get life, some get death, some get 50 years or so. IMO dead is always the same outcome, how come the punishment is so different in every case? Is there a clause that a judge follows (did he do it like this? did he use this to kill them? was the victim so and so age? is the victim a cop?) or is it as lame/simple as a murderer having the right jury???

Death penalty is supposed to be applied due to special circumstances. Unfortunately, the penalty is not applied fairly, since I'm pretty sure we all know justice is NOT blind. If you are poor or a minority, you're basically fucked. It takes money to save your life.

it depends greatly upon the death penalty laws & statutes in each state that has them.
Kansas law requires that special circumstances exist for a defendant to be eligible for the death penalty. Such circumstances include the killing of a law officer, more than one person or a victim kidnapped for ransom or rape, or killed in murder for hire.
in this case, the district attorney could not bring charges that would grant the death penalty due to KS state law.
it sucks, but that's their law. :aaron:
