so i got a speeding ticket and i received the bail amount paper in the mail...i just noticed that on the citation, the misspelled my last name and on the notice i got in the mail too... my last name is ALEMAN, and they put ALEMAD.
is this enough to get me out of the ticket?

i got all the info pat gave me, but i figured if i could get out for the name, it would be even easier....i will wait for a LEO to respond so i can have the definite answer.

Were you speeding?
Was it you that he pulled over?
Did you sign that citation?
When you go to court, will the Officer be able to identify you as the one he cited?
If I was the judge, then the one letter off would be irrelevant.... but I'm not, so anything is possible.

well if what jose said was right, then what pat said was right too! can't be staked out in someones personal driveway unless the spot is approved.... if it is, then just ask for traffic school and make sure u bring a #2 pencil lol

if the citation was for "unsafe speed" it will be easier to fight it with trial by declaration. unless you're the honest type that just pays up.

What if it was an unjust ticket and you honestly dont deserve the ticket ?
I won 2/3 speeding tickets cuzz the officer didn't show. 1st one i just paid off.But they always bring down the amount of the ticket if you show up and just explain yourself. Its usually just the bail amount.
i would fight the ticket if u have the day off. it could save you a weeks pay.

i doubt most people think they "should" be let off, they just fight it anyway. just hope that the cop is either lazy, or a high school/GED graduate who can barely write an essay

Maybe if u'r a baller, you cant just pay the ticket without batting an eye at the price. but if you ever sat there like i did and was basically one of the last ones to be called up, you can actually see that the judge brings down the amount or its dismissed OMG you go to court to try and save a little bit of money. It's not about being cheap, but its luck of the draw, maybe the cop will show , maybe he won't otherwise you'll just pay w/e the amount due was or ask for a cheaper price. I know i dont make a fuck ton of money like you sorry playa ! :bling3:

i respectfully disagree. I just got a ticket a week ago for doing 85 on the freeway. Excuses aside, I will extent my legal right to dispute this citation and be waived of any charges. If for no other reason, to gain more experience with the legal/judicial system. Sure I could end up wasting a day at a courthouse, but I see it more as a learning experience. You could go your entire life just paying the tickets you deserved and never learn a thing; then when the time comes where you have a valid reason to contest an offense (traffic citation, civil case, criminal case) and be at a loss for a lack of experience with defending yourself or understanding your rights and abilities as a defendant.

Ya, when i went for my 2nd ticket, i figured " fuck it " i'll just go and see what happens. Cop didnt show.
3rd ticket i realized that they cut the bill a ton from the last time i went, so i figure i go, Cop Didnt show that time BUt i would have had a good reason & Valid explanation if he were there. But like i said, no show, so dropped.

Myth #1.. Even if I was lazy, I don't have the option of not showing up for traffic court. The only time I missed traffic court was to be present at another courting hearing, with a felony type crime. I get reprimanded if I miss court without an excuse.
Myth #2.. I would say a majority of the Officers have some form of higher learning. IE... BS or Masters. What kind of essay is required to say, he ran a red light or he was speeding?

I'm not buying the experience thing. Most people follow the law and will never have the opportunity to be a defendant in court. If you want to learn about the judicial system, take some CJ classes in school or just sign up for jury duty.

The fees are way out of control, but that does not stop me from issuing citations to people who deserve them. If you go to get off on some technicality, then that shows a little insight into your character.

-i was assuming it would be TBD, not going to actual traffic court. the chance of winning at traffic court is very low, since the cop will be able to directly counter your arguments. you would basically be betting on the fact the cop *might* not show up. TBD has worked very well for my friends' tickets (legitimate or not). even if you lose the TBD you can still get another trial at traffic court.
-not all of them are graduates, i didn't mean "most" are GED/high school. even then, i have "heard" that some people just aren't good at writing reports (whether they have a degree or not), which leaves holes for trial by declaration. it is easy to bring up facts on-the-fly while in court, it will be more difficult to make a very sound argument in a TBD when the other side's argument isn't known.

How would you go about asking a judge "sucessfully" for a fee reduction, and/ or what fees would expect to "sucessfully get waiver, if you were to ask for certain fees to be reduced?"
