Here is the scenario.


I have a family/ Friends that live down the street. THere neighbor got evicted and was forced out of his home and all his junk is lying on the curb where it is also sitting my friends house aswell.

Well they decided to help him clean up his materials and belongings since he had a truck there today to help move his stuff. Well it took a little longer as usual and the evicted man grabbed my friends wife by the hair and started pulling on her head left 2 right being all mad at her for talking to him. Now my friend came home from work after hearing this and beat this guy for touching his wife and abusing her the way he did.

If no charges were pressed by that old man can police still press charges on my friend if they see physical abuse towards the old man that started this whole drama fest?

I missed this cuzz i was there about 5 min earlier and decided to leave.

if so they would also have to press chargers on the person that assaulted the women. charge would i believe be assault+battery.

unless you're a law enforcement officer, let's leave the speculation out of the thread please.

Yes... If the old man decides to call police or walk to the station to get a report, they will take one. The charge is just Battery. Depending on the age of the old man, detectives might try to add elder abuse.

In the short run... the crime of battery is a misdemeanor offense that did not happen in the presence of a Police Officer. So.. the old man would have to invoke a private persons arrest, or wait for detectives to put a warrant in the system. The good thing is... he hasn't reported the incident yet, since the Police haven't knocked on your door and he's probably scared that your friends wife may want him arrested as well.

I wouldn't sweat it.. but I would also lay low for a while. The old saying "out of sight, out of mind" means a lot when not trying get a case put on you.
