View Full Version : Got cited on my way to Mammoth today

So.. just renewed my license this week and broke it in today with a speeding ticket via the 395 going up the mountains. Not mad, just pretty bummed... its the first moving violation I've received. CHP got me with radar at 82 in his stealthy black charger, which I must admit looked :drool:. It works, I didn't see him til he had the red and blue strobes going strong on my ass. He walked up and said "Hi there, so I got you for speeding." I figured it best not to say much, so I just said "ok" and handed him everything and that's all there was to it. He came back and cited me for 75.
My question is, being that I've never had to deal with this before and I'm pretty ignorant when it comes to this whole process- what are my options to avoid this going on my record (insurance increases)? I'm not discounting the fact I was above the speed limit, but I feel that given the circumstances (amount of traffic, visibility/weather, road conditions etc) I was driving safely and I feel that I could argue that point. I was going with about 4-5 other cars for a goodwhile.. just happens that my friends red crv made me the lucky one. Thing that sucks is about 10 minutes prior I was telling my friends in the car how nice it would be to have a radar detector. Obviously I'm not going to be making it to court in Inyo as I live in Orange County, so what can I do?

im not a cop, but ive received my fair share of tickets.
if you want to avoid going to the court house and DO NOT want to fight it, wait a few days (about 5 business days or so) and go to the DMV website. they have a section there where you can pay the ticket online and request traffic school for an additional fee.
seeing as to how this is your first moving violation, you are eligible for traffic school. you complete traffic school (paying whatever the school charges you), and once complete either they will mail the certificate to the court or you can mail it or deliver it to the courthouse. traffic school, although more money, will keep the point off your record and your insurance will not be notified of it, so you shouldnt see any change with your insurance.
I gotta admitt, i admire you for taking responsiblty for your actions and not trying to fight it. ive had a CHP officer let me off easy a few times, one clocked me at 92mph and gave me the ticket for 80 even though i didnt have my license on me since i had forgotten it at my friends house the night before.

Thanks for the advice. Well I mean, if I can avoid the fine that would be nice.. But yeah, CHP gets a bad rap. Your going to have your assholes, but that's the case anywhere. Of course I would have preferred to not get pulled over today, but people never seem to recognize that they have a job to do too. They deal with bullshit and asshole people all day long who lie or make excuses. exactly. he could have, but one thing ive learned is always, no matter how pissed off you are, be polite to the officer. it really goes a long way.

Doesn't matter what the circumstances were, you could have been the only one on the road and still get cited for speed since the law states that the MPH posted is the max limit and the speed for safe driving (hence why it's called the speed limit).
Your options are if you don't want to go to court, do a trial by declaration and either fight it (doubt you'll win since he got you with the radar) or request traffic school. In the case of traffic school, you'll pay the fine and take traffic school, once you complete traffic school the cite will be dismissed and won't go on your record.
But whatever you do, make sure you take care of the cite or else it will go to a warrant for an FTA (failure to appear) which you do not want.

Everything everyone said is correct....
Maximum speed signs are posted on fwys.... no going higher than that. Signs posted on streets are Speed limit signs that are set by an average safe speed survey. You can defend going over the limit by a few mph, when it is safe to do so... ie.. 4:00am, no one else on the road, 1000ft visibility, dry pavement, ect...

I'd say just sign up for traffic school. It wont appear on you record unless you dont show or pay for the fine. Or you if have multiple prior violations.

not likely, 28mph over isn't horrendous.
excess of 100 you may be arrested with an impound on your car, but of course with everything it's up to the discretion of the patrol officer.

haha i heard that!
was pulled over for expired registration in the escort a few weeks back, and SDPD didn't write me a ticket because he "just doesn't feel like it"
very surprising given the 3 or so points on my record and numerous previous violations

ahh... i suppose but i've been pulled over a few times after having lost my license and simply gave them the license number, they looked it up in their system and had nothing to say about it.

nice, im in the condos at fireside... basically just at the other end of the gondola opposite of canyon lodge. what about you? I was at the light show too, gotta say it was kinda boring haha i was waiting for the snow mobiles to start doin tricks and shit. The powder has been pretty decent though, got some good runs in today :D

Yeah man, I was pretty bummed. Cop was cool, but still sucks. I got some awesome runs in though, its been a good trip. It started snowing today and the powder was soooo nice on my last couple runs but then it got too cold and visibility at the top of the mountain was pretty bad. Wanted to get a couple more runs in today but its all good.

I was at canyon lodge! Yea it was boring hit up the village afterwards the dj from the light show busted out a trance/house set at a bar. Snow was great had good runs. Hoping to go back in feb. Jan is gonna be spent at mthigh.
Nice, I still got a year to go before I can party hardy (21 next December)... This is the only time I'll probably be up here this season, its one of my favorite places to play but god damn its expensive. The resort has a fucking monopoly over the mountain. I'm cruising up to bear or mt. high on either the 7th or 8th though :cool3:

Well what the heck happened there? Which detector do you have? Were you the only car on the road? On the 395, unless you were the only car on the road the detector should have picked him up well before. I know those things aren't perfect, but they're supposed to thrive out on long/flat roads like the 395.
Jeeze, 82 is like cruising speed in LA. You'd think he'd have plenty of +85 people to keep in busy out there on the 395.

one time this guy was in the fast lane going SUUUUPER slow...like 50mph. so i downshifted once the car next to me passed and took off around him. i didnt notice the chp sitting right behind me in the carpool lane. he lit me up so fast i laughed. when we got on the side he came up and i said "well that was stupid..."
he let me go.

he let me go.
the guy doing 50mph was also just as much of a hazard as you speeding

i didnt speed... i just kicked it up from 50mph to 70'ish or however fast everyone else was. i just did it at WOT or however fast my little NPI mustang goes. heh.

Incorrect- CHP got me even with my radar dector at 82 mph.
Correct- CHP got me with his radar gun while I was traveling at 82 mph.

There is a law on the books called the "basic speed law". I have used this in the past, and gotten out of two tickets (this was awhile ago)
First, no matter what if you are going over 65 mph, you are screwed..period.
That being said, this works in area that have say a 45 mph posted speed limit. And you are going say 55 mph and you get cited. Make no mistake the burdon of proof is on you to prove it was a safe speed to travel at that time (ie: 4:00am, no one else on the road, 1000ft visibility, dry pavement).
